Consent according to the GDPR
If a
company wants to process personal data,
it always needs a legal basis as a reservation of consent. If a company does
not have a permissible legal basis for processing personal data, the processing
is not allowed.
In the General Data Protection Regulation, the legal bases are regulated
under EU-GDPR Art. 6. According to EU-GDPR Art. 6 (1) para. 1a , processing is
legal if the data subject has given their consent to the processing of their
data for a specific purpose.
A declaration of consent should be made by a definite confirmatory act. For instance, this can be done by a
signature or in some cases with a verbal confirmation. In all cases, the
declaration of consent must be verifiable.
In general, when the declaration of consent is obtained, the data subject
must be informed about the collection, use and processing of their personal
data. This information can be provided by a data protection declaration.
Declaration of consent in vistrax checklists
For a simple process, we have developed a checklist template with that
your visitor can give his consent for data processing.
I hereby confirm that:
"Muster GmbH" is allowed to collect and process my personal
data (name, telephone number, e-mail address, postal address, etc.) for the
purpose of tracing visitors. For this purpose, the data will be stored on the
servers of "Muster GmbH" and can only be viewed and processed by
authorised persons. If additional data is required, separate consent is
required from the visitor. Further information can be found in the data
protection information for visitors (version xx). Deletion of the collected
data (automatically) takes place after "XX" months.
